Terms of Service

1. The Service

The Service is a unified public-records data layer accessible via the Model Context Protocol (MCP) and HTTP API. The Service is operated by ACK Ventures, a California sole proprietorship ("we," "us").

2. Eligibility and US-only service

The Service is offered exclusively to users located in the United States. By creating an account, you represent that you are accessing the Service from the United States and are at least 18 years old. The Service is not available to users in the European Economic Area, the United Kingdom, or any jurisdiction where its offering would be unlawful.

3. Accounts and API keys

You are responsible for safeguarding API keys issued to your account. Keys are scoped per account; sharing keys across organizations is not permitted. You are responsible for all activity that occurs under your account or API keys.

4. Acceptable use

  • You may use the Service for research, due diligence, journalism, product development, agentic workflows, and similar lawful purposes.
  • You may not redistribute the data in bulk to third parties without our written permission.
  • You may not cache, store, persist, or republish Service responses beyond the immediate AI-agent session that retrieved them. Each query should be answered live by calling the Service; building a local copy of the dataset (or any meaningful subset of it) is prohibited.
  • You may not systematically extract or bulk-pull data — including but not limited to: enumerating jurisdictions, paginating through results to assemble a corpus, automating sliding-window date queries to capture full history, or any other access pattern designed to acquire the dataset in aggregate. The Service is intended for in-context agent calls and ad-hoc research, not as a bulk-data export.
  • You may not use the data for purposes prohibited by applicable law or by the terms of service of the source from which it originates (see /attributions for source attributions and links to upstream terms).
  • You may not use the data for harassment, stalking, or as a consumer report for credit, employment, insurance, or housing decisions where regulated by the Fair Credit Reporting Act.
  • You may not attempt to circumvent rate limits, scrape the API, reverse-engineer the Service, or interfere with its operation.

5. Source-data licensing

The Service aggregates public-records data from third-party municipal open-data portals. Each underlying source has its own terms of use; some require attribution. By using the Service, you agree to comply with the upstream terms applicable to each source you query. Current source attributions and links to upstream terms are listed at /attributions.

6. Pricing and refunds

Free tier is free. Paid tiers (Pro and Team, at the prices listed on the dashboard) are billed monthly via Stripe. You can cancel at any time from the dashboard or the Stripe Customer Portal; your plan remains active until the end of the current billing period.

Refunds: pro-rated for the unused portion of the current period if requested within 7 days of charge. Beyond 7 days, charges are non-refundable except where required by law.

7. Data accuracy disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." Public-records data is sourced from third parties and may be incomplete, outdated, or contain errors. WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, AS TO THE ACCURACY, COMPLETENESS, TIMELINESS, OR FITNESS OF ANY DATA FOR ANY PARTICULAR PURPOSE. Always verify against the issuing authority before making decisions of legal or financial consequence.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACK VENTURES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold harmless ACK Ventures and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) your violation of any applicable law, or (c) your violation of any third-party right, including any upstream source's terms of use.

10. Termination

We may suspend or terminate your access for violation of these Terms, or for non-payment. You may terminate your account at any time from the dashboard. Sections that by their nature should survive termination (including disclaimers, liability limits, indemnification, and dispute resolution) survive.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms shall be resolved exclusively in the state or federal courts located in the State of California, and you consent to the personal jurisdiction of those courts.

12. Changes

We may update these Terms; material changes will be announced via email to active accounts at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

13. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ACK Ventures regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
